Mr. Smith was hired on under false promises. He promised he would not be overloaded but every time I talked to him he has claimed to be so busy with other cases he could not call me back till weeks or months later sometimes.after being asked to provide a copy of our contract he would tell me no. He claimed hes done an investigation but could not find reports I requested that would prove exculpatory, even going to the lengths as saying its probably all in your head. After only one week of being out I was able to pull up the very same reports using the very same info provided to him showing his negligence. When asked to file for a bond reduction he would not cited the case law pertaining to my case under txccp art.17.151 release because of delay which would fall under ex parte jones 803 s.w. 2d 718. Smith would constantly degrade me as a defendant and as a human being claiming "criminals are dumb I'm the one with a law degree". Smith made sure for the hearing A) I was not present and B) I was restricted out of the county over 200 miles away so to not be able to contact witnesses or check on my own property income. Smith has not contacted a single witness in my case or challenged lack of evidence to prove probable cause. He has not gone over any of the evidence with me except for a statement. When asked of his investigators name he will not provide it and when I hired my own investigator he will not allow him to see all of the evidence. He has kept me from all hearings which is a violation of txccp art 28.01 (pretrial) and has done hisdispicable duty to prevent me from having a fair trial. On his motion to withdraw from my case he claimed I did not pay him, I had proof via text message he had the check and I only asked him to wait a few days to deposit it due to financial troubles I had that he knew of. Then he filed an addendum to the motion that day saying the relationship was not working. I was not allowed to talk or elaborate of course so he was granted permission to withdraw with out a proffer of facts and my request for a grievance or my money paid to him back was not granted. He even gave me the wrong time for the hearing hoping I would not show up, but of course he believes text messages are proper form of notice even though they have the wrong info in them. Mr. Smith is deceitful and will tell you or your family anything to get your money, his knowledge of the law has proved under par and only relies on his relationship with the prosecutor or judicial members to make a case. I have proof of all statements and none of what I state in this article is based on biased opinion.
