He threatened Small Claims Court if I didn't cough up the money. That got my attention.
I requested a copy of the lease agreement to make sure there wasn't anything else I might be liable for. In the move, I managed to misplace my copy. He said he couldn't find his copy and that it has nothing to do with utilities. I thought something wasn't quite right with that response and it left me wondering why he was being evasive about this.
The building I rented is a very old barn that was converted to an apartment, but it left no doubt that it was a barn; very, very rustic; rodents, insects, etc.
In the event this matter did make its way to court, I figured it would be best to learn as much as I could about the rental and my rights. I did some reading online and came across a few things.
I took a drive down to the County building and planning department to have chat to confirm or deny what I learned . This was a very fruitful and informative meeting.
It turns out that the building he leased me was not permitted as a residential unit and that their records prove he knew this material fact! The building lacked what is known as a "Certificate of Occupancy", which is a document that states a dwelling is permissible for habitation. This structure lacked the certificate due to numerous code and fire violations on record!!
Armed with this knowledge, I thought it would be prudent to seek a second, but more importantly, an expert opinion. I did a google search and found two law firms that dealt with tenant law. I call the first one and was told that someone would give me a call, but first I needed to fax them a copy of the rental agreement. I told them that I couldn't find it but that my questions were of a general nature. I was told, by the gal doing the "intake interview, that the attorney needed it before they would speak with me. I sent an email asking for someone to reach out to me and that I was in need of some help.
No one from that office returned my call or email.
I can't mention the name, but they are a large firm in the city.
My second call was to Tobener Ravenscroft. Again, there was a brief intake interview and after it, I was told I would receive a call Wednesday at 5pm., two days for today.
So here we are, Wednesday. It is 5:04pm and the phone rings. It is Ms. Collins from Tobener Ravenscroft.
As far as first impressions go, this firm was off to a stellar start.
I told Ms. Collins my tale of woe but not what I had already learned from my own due diligence. She confirmed everything I had already learned from the web and from the folks at the County. But there was one kernel of information she shared that changed for me, the trajectory of this problem.
She said, and I paraphrase, "a contract that is entered into illegally, based on fraud, or in violation of state, county, or local law or code, is not enforceable. The entire agreement is void!
This is huge!! It means that not only am I not liable for the money the landlord seeks, but that ALL the money I paid him in rent could possibly be awarded back to me if I were to pursue a complaint in court.
I love the law!
Thank you Ms. Collins for putting my mind at ease by showing me that the law is clearly on my side.
If this matter does see the inside of a courtroom, you can be sure that I will be retaining Tobener Ravenscroft LLP.
Thanks again.
Herewith, praise for the most excellent tenant lawyers of Tobrener Ravenscroft.
We are a 70-something couple living in a rented house in SF's Sunset. On November 1, we received a notice of a 21% rent increase to take effect 1/1/20. After weeks of research into records of the property and its owner(s) and of attempted negotiation through the property manager, we did what we should have done at the beginning, arranged for a consultation with Tobener Ravenscroft.
In half an hour, Mr. Tobener asked a series of pertinent questions and answered our not-as-precise ones, assessed the situation and gave us a realistic view of our options. Then. . .as we prepared to leave, he recalled a timely article about anti-price gouging legislation that covered our situation precisely. He sent us a link with a template letter, which we adapted and sent straightaway.
The result: in less than a week came a response rescinding the rent increase entirely, declaring it null and void, and restating the current rent, with no mention of any plans to increase it.
30+ years in San Francisco and we can't recall a more satisfying skirmish in its property wars. Well done, sir!

And... we prevailed. I am very happy with the outcome.
Not all claims are worth pursuing, and I would say, from the perspective of a potential client, that this hard truth explains any of the negative reviews you may have encountered about this firm. Tobener Ravenscroft will give you a sober and compassionate read on your chances for justice. If they do choose to represent you, you are in good hands. They're clear, communicative, prompt, and reassuring, and they fight like hell for you. Even though my tenancy dispute was one of the most stressful times of my life, it was a joy to work with Jackie, Christa, and Joe, and to witness their smart and purpose-driven lawyering.
There's no justice in this world without good advocates, especially in this wilderness of a housing market. Tobener Ravenscroft are perceptive, diligent, badass advocates who can restore your faith in justice. Good luck and godspeed to all the wronged tenants out there - and please give Tobener Ravenscroft a call!
Tobener Ravenscroft are the tenants' rights specialists I was looking for. Without getting into specifics, Joe, Jackie, Christa, and their support staff handled our case with expertise. They kept us updated throughout the process, listened to and respected our wishes as the case progressed, prevailed in motion practice, and ultimately obtained a result that far exceeded our most optimistic expectations.
Tobener Ravenscroft is now the tenants' rights firm to which I refer my loved ones in the Bay Area when they run into problems with their landlords. If you are having problems with your landlord, I highly encourage you to give them a call and see if they can help.
If you have tenant’s issue I highly recommend calling Brian.
Thank You and I highly recommend Tobener Ravenscroft LLP
It was refreshing listening to a 3rd party explain our rights and the best way to proactively address my landlord's claims, while our conversations also gave me peace of mind that despite our landlord's insinuations, we had a legal leg to stand on. I would highly recommend consulting the Tobener team on any tenant's rights issues instead of doing piece meal research online or simply taking a landlord's words for fact.
Being harassed my tenant and retaliating against me. The person took all the information from me about this wrongful eviction and then she advised me that sorry we are not able to take your case? I am trying to understand why because I have a solid case and I have been referred by a friend who knows them and have worked with them in past. Still trying to understand why they refused to represent me.
I highly recommend them for their professionalism, experience and especially compassion, which at times is lacking in this field. And although I don't wish you have to ever go through an issue with your landlord, in case you do, this is the only law firm I would recommend.
My experience what I call the Dream team is because the impossible was pulled off. I was up against a slumlord that did everything possible to get away with being what he really is. An individual who doesnt abide by laws that we are supposed to abide by. Being a single parent in a very expensive county is no joke.
Having to practically work 3 jobs to survive practically not kidding almost killed me. I had a daughter I had to support and make sure she was educated. This man turned my world upside down literally, not wanting to fix anything but put a bandaid on it. Got sited and financially taking from me, along with not returning my deposit so I can move in a hurry.
The stress overwhelmed me and my health got worse, also affecting my work performance . I have been fighting with this team on my side and it finally came to an end.
I had a fighting team no matter how annoying I probably was due to frustration and anger. They stuck it out even when there was no hope that the truth would prevail. Kind, empathetic, educated, patient,.understanding. This is a team that stuck it out when I wanted to give up. Honest also not giving false hope told me what could happen almost did.
Prayers had to of been answered this was an experience I will never forget. I can only hope anyone out there afraid to come forward, please dont you owe it to yourself and your hard working family. No one should live in fear paying for stuff that doesnt work or being retaliated against. Renters do have rights if you are good tenant you need to come forward.
Please I advise you to take pictures, and documentation just in case it will matter in the end. This is the team you need on your side.

I would highly recommend them!
Mr. Tobener is a fearless fighter and as smart as they come. He knows the laws concerning tenant rights. Every communication I sent to him received a response in a timely manner. Every time I would think 'I wonder what the progress is?' I'd get an email updating me. This work is intuitive for him. His staff is great too. My outcome was WAY better than I ever hoped for. I can't thank him enough. I would absolutely recommend him to any tenant in trouble.
From the beginning, this firm was exceptionally professional and responsive: I called late on a Friday and arranged for a phone consultation on Monday, where it was clear that Julia Wobbe, the lawyer I worked with, had already reviewed my story and was able to immediately offer advice and reassurance. When I asked for a letter to be sent to my landlord ASAP, I was very impressed that it was completed that same day.
Over the next few weeks Julia kept me up to date with everything that was happening, and made sure to explain everything in a way that made sense to a non-lawyer. Her advice was always spot-on, and I thought she was very realistic and accurate in predicting how things would turn out and what the process would look like. I also felt that she was very respectful of my time/money, giving various options for how to proceed at every step, and very open to my concerns and suggestions.
Overall, I would recommend Tobener Ravenscroft and Julia Wobbe to anyone who needs a tenant lawyer - they are outstanding!
Once my elder tenant parents decided to seek legal help with their situation, I did a fair amount of research, and upon our initial meeting with Joe, felt confident they would be represented by a very competent attorney with expertise in and a strong commitment to helping and representing tenants. My parents also felt relieved and optimistic after several months of stress.
The result of the negotiations exceeded our expectations, and we are all incredibly grateful for the care along the way and the very positive outcome.
Thank you guys once again!
Tenants and landlords don't always get along, its human nature.
Sometimes landlords can be Bullies.
Money rules the world.
Navigating the complicated world of San Francisco rentals can be overwhelming. There's so many facets to it.
I personally rely on this office for all of my landlord tenant concerns.
They offer phone consultations.
Great deal, and very knowledgeable advice.
Sincerely,
A greatful tenant -

I found Joe Tobener by Googling "SF Tenant's Rights Attorney". All these news articles popped up quoting him. I called their office just to ask if I was getting a fair buyout on my apartment. They answered on the first ring(!), took some brief info and told me someone was going to get back to me later that day (!!!) -- FOR FREE (!!!)
The lawyer asked me smart questions for 45-minutes, said she was going to confer with the partners and get back to me. True to her word, she did; giving me options to pursue or not. I had to ask her what she would do before she'd give me an opinion. The topper: I asked what I owed them - $0.00.
I highly recommend Tobener, Ravenscroft.
Their experience with this particular type of law in San Francisco was very apparent. It helped set our minds at ease in what is a horribly stressful thing to go through. Their ability to understand and explain everything was a huge plus and we couldn't have asked for more professional representation. As a bonus, they are genuinely nice people.
We were very, very, very pleased with our outcome.
